General Terms & Conditions
Effective date: September 2, 2026
These General Terms & Conditions (“General Terms”) govern purchases, enrollments, accounts, credentials, educational programs, institutional services, and related offerings made available under the GentleDraw™ name (collectively, the “Services”). The Services are offered by GentleDraw Spa LLC, doing business as GentleDraw, under license from Novelle Innovative Ventures LLC, which owns the GentleDraw proprietary methodology and related intellectual property. In these General Terms, “GentleDraw,” “we,” “us,” and “our” refer to the applicable GentleDraw operating entity identified on your order confirmation or written agreement.
By purchasing, enrolling in, accessing, or using the Services, you agree to these General Terms, our Website Terms of Use, Privacy Policy, Refund & Cancellation Policy, Limitations & Disclaimers, and any course-specific, credential-specific, or institutional terms presented to you. If a signed institutional agreement, order form, or statement of work conflicts with these General Terms, the signed agreement controls for that engagement.
1. Eligibility and authority
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or enroll in the Services. If you enroll or purchase on behalf of an employer, school, healthcare organization, or other entity, you represent that you have authority to bind that entity to the applicable terms.
The Services are intended for professionals, students preparing for professional work, organizations, and other adult learners. They are not directed to children.
2. Nature of the Services
GentleDraw offers education concerning patient experience, trauma-informed communication, patient dignity, and supportive approaches to blood draws and other needle-related encounters. GentleDraw may also offer proprietary certifications, specialty distinctions, institutional education, implementation support, and related materials.
GentleDraw education is not venipuncture training, is not a phlebotomy course, and does not teach or authorize a person to insert needles, draw blood, administer an infusion, diagnose, treat, or perform any medical procedure. Completion of a GentleDraw program does not create or expand professional licensure, certification issued by a governmental authority, scope of practice, clinical privileges, or employer authorization. 3. Accounts and accurate information
You may be required to create an account through the GentleDraw certification portal or another approved platform. You agree to:
- provide accurate, current, and complete information;
- keep your login credentials confidential;
- use only your own account unless GentleDraw expressly authorizes organizational administration;
- promptly notify us of suspected unauthorized access; and
- accept responsibility for activity occurring through your account to the extent permitted by law.
Accounts, enrollments, examinations, completion records, and credentials are personal and may not be sold, transferred, shared, or assigned without our written permission.
4. Orders, fees, taxes, and payment
Prices, available payment options, included features, and access periods are displayed at checkout or stated in the applicable written agreement. You authorize the payment processor to charge the payment method you submit for the amounts shown at checkout, including applicable taxes. You are responsible for any bank, card, currency-conversion, or similar charges imposed by your financial institution.
Except where an auto-renewing option is clearly disclosed and separately accepted at checkout, a GentleDraw purchase does not authorize recurring charges. Credential renewal or recertification fees are charged only when due and when you submit or authorize the applicable transaction.
We may correct pricing or description errors before accepting an order. If we cancel an accepted order because of our error or inability to deliver the purchased Service, we will provide an appropriate refund for the undelivered portion.
5. Course access and technology
Course access begins when access is granted through the certification portal, unless the applicable offer states a different start date. The access period displayed at enrollment is part of your purchase. Current self-paced GentleDraw programs may provide a 15-calendar-day access period, but the specific enrollment page or order confirmation controls.
You are responsible for reviewing the stated access period, planning sufficient time to complete the program, and maintaining a compatible device, supported browser, reliable internet connection, and an email account capable of receiving program communications. Maintenance, security events, and circumstances outside our reasonable control may occasionally interrupt availability. We will use reasonable efforts to restore access, but uninterrupted operation is not guaranteed.
Any extension must be authorized by GentleDraw. Where an enrollment permits one paid seven-calendar-day extension, it may be purchased only once and must be used for the same learner and course. Current planned extension fees are $150 for the GentleDraw Practitioner Certification Program and $100 for GentleDraw Fundamentals. Any different fee or eligibility rule displayed at the time of purchase controls.
6. Assessments, completion, and credentials
Course completion, passing an assessment, and receiving a GentleDraw credential are separate matters. Each program may establish attendance, module-completion, assessment, identity-verification, conduct, renewal, or other requirements. Where a program specifies a 90% passing score, the learner must satisfy that threshold to pass.
You agree not to obtain or provide unauthorized assistance, copy or distribute assessment content, misrepresent identity, falsify completion, or interfere with assessment integrity. GentleDraw may investigate suspected misconduct and may invalidate an assessment, withhold or revoke a completion record or credential, suspend access, or require reassessment when reasonably supported by the circumstances.
A GentleDraw credential is a private, proprietary indication that the credential holder satisfied GentleDraw’s requirements for the identified program at the time awarded. It is not a state license, board certification, accredited academic degree, governmental credential, or authorization to practice. Credential holders remain responsible for maintaining all licenses, employer approvals, supervision, continuing education, and competencies required for their actual work.
Any credential term, annual renewal, five-year recertification, continuing-education requirement, or use of a credential badge or designation is governed by the requirements communicated for that credential. Current planned fees are $150 for annual renewal and $250 for five-year recertification, subject to the terms and pricing presented when due.
7. Professional responsibility and conduct
You are solely responsible for applying educational concepts within your education, competence, license, scope of practice, workplace rules, applicable law, and the needs and consent of each patient or participant. You must not state or imply that GentleDraw directs or supervises your clinical practice, guarantees your competence, endorses your employer, or assumes responsibility for your acts or omissions.
You may not use GentleDraw education, credentials, or marks in a deceptive, unsafe, discriminatory, harassing, or unlawful manner. You must not misrepresent your credential status, alter credential materials, or make unsupported claims about patient outcomes, pain, anxiety, clinical success, or regulatory compliance.
8. Institutional services
Institutional education, pilots, implementation assistance, group enrollments, licenses, and consulting services may require an order form, statement of work, license agreement, or other written agreement. That agreement may address scheduling, participant counts, travel, cancellation, confidentiality, data responsibilities, deliverables, acceptance, and fees. Unless expressly stated in a signed writing, GentleDraw does not provide clinical staffing, medical supervision, regulatory approval, or legal compliance certification to an institution.
9. License to use educational materials
Subject to payment and compliance with these General Terms, GentleDraw grants the enrolled learner a limited, personal, nonexclusive, nontransferable, revocable license to access and use the purchased materials during the applicable access period solely for the learner’s education and permitted professional reference.
You may not reproduce, record, download except through an expressly enabled feature, distribute, publish, sell, sublicense, translate, adapt, publicly display, create derivative courses from, scrape, data-mine, or use the Services or materials to train or evaluate any artificial-intelligence or machine-learning system. You may not share login credentials or provide course access to another person. Additional rules appear in the Intellectual Property Notice.
10. User submissions and feedback
If you submit an inquiry, assignment, survey response, testimonial, suggestion, or other content, you represent that you have the right to provide it and that it does not violate law or another person’s rights. Do not submit patient-identifying information, protected health information, confidential employer information, or third-party materials unless GentleDraw has expressly requested them through an approved secure process and you are authorized to disclose them.
You retain ownership of content you submit. You grant GentleDraw a limited license to host, reproduce, and use that content as reasonably necessary to provide, secure, support, and improve the Services. We will not use your name, likeness, or testimonial publicly for promotional purposes without any consent required by law.
If you voluntarily provide ideas or general feedback that do not contain your confidential information, you permit GentleDraw to use them without restriction or compensation.
11. Suspension and termination
We may suspend or terminate access, invalidate completion, or revoke a proprietary credential when reasonably necessary to address nonpayment, account sharing, intellectual-property misuse, assessment misconduct, material misrepresentation, unlawful conduct, threats to platform security, misuse of a credential, or a material breach of applicable terms. When appropriate, we may provide notice and an opportunity to respond. Immediate action may be taken when needed to protect learners, patients, the public, GentleDraw, or third parties.
Termination does not eliminate payment obligations already incurred or provisions that by their nature should survive, including intellectual-property, confidentiality, disclaimer, limitation-of-liability, indemnity, and dispute provisions.
12. Refunds and cancellations
Refunds, preorder cancellations, access extensions, duplicate charges, credential fees, and institutional cancellations are governed by the Refund & Cancellation Policy and any more specific written terms presented for the transaction.
13. Privacy and communications
Our collection and use of personal information are described in the Privacy Policy and Cookie Policy. Transactional communications concerning access, security, assessments, credentials, or purchases are part of the Services. You may opt out of promotional email through the unsubscribe method provided, but you may continue to receive necessary service communications.
14. Third-party services
The Services may rely on or link to third-party platforms, including course-hosting, payment, communications, and scheduling providers. Those services may have separate terms and privacy practices. GentleDraw is not responsible for third-party content, policies, outages, or conduct, but this does not limit responsibility that applicable law places on us for our selection or use of service providers.
15. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. GENTLEDRAW DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT A WARRANTY CANNOT LAWFULLY BE DISCLAIMED. WE DO NOT GUARANTEE THAT A LEARNER WILL PASS, EARN OR RETAIN A CREDENTIAL, OBTAIN EMPLOYMENT, RECEIVE EMPLOYER OR REGULATORY RECOGNITION, IMPROVE A CLINICAL OUTCOME, OR ELIMINATE PAIN, FEAR, ANXIETY, TRAUMA RESPONSES, OR PROCEDURAL COMPLICATIONS.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GENTLEDRAW AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, INSTRUCTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM A LEARNER’S OR THIRD PARTY’S CLINICAL ACTS, OMISSIONS, OR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE GENTLEDRAW PARTIES ARISING FROM A SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID GENTLEDRAW FOR THAT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF YOU PAID NOTHING, THE CAP IS $100. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Some jurisdictions do not allow certain warranty exclusions or damage limitations. In those jurisdictions, the exclusions and limitations apply only to the extent permitted by law.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the GentleDraw parties from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, violation of these General Terms, infringement of another person’s rights, misuse or misrepresentation of a GentleDraw credential, or clinical acts or omissions outside GentleDraw’s control. This obligation does not apply to the extent a claim was caused by a GentleDraw party’s own unlawful conduct.
18. Governing law and venue
These General Terms are governed by Florida law, without regard to conflict-of-law principles. Unless applicable law requires otherwise or a signed agreement provides a different forum, any legal action arising from these General Terms or the Services must be brought in a state court located in Palm Beach County, Florida, or the federal court with jurisdiction over Palm Beach County, and each party consents to that forum. Nothing in these General Terms prevents either party from seeking appropriate temporary or injunctive relief concerning intellectual property, security, or misuse of confidential information.
Before filing a claim, we encourage you to send a written description of the issue to Info@GentleDraw.com so the parties can attempt an informal resolution. This sentence does not shorten any legal deadline or require you to surrender a nonwaivable right.
19. General provisions
If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent; we may assign these General Terms in connection with a merger, reorganization, financing, sale of assets, or transfer of the relevant business. We are not responsible for delay caused by events beyond reasonable control. Headings are for convenience only.
These General Terms, together with the incorporated policies and any applicable order confirmation or signed agreement, form the entire agreement concerning the covered Services and supersede prior statements about the same subject.
20. Changes and contact
We may update these General Terms. The effective date above identifies the current version. Material changes will apply prospectively and will be communicated when required by law. Continued use after an updated version takes effect constitutes acceptance to the extent permitted by law; additional affirmative consent will be obtained when legally required.
